"el ser y el hacer"

I'm translating a legal/poli-sci article, and there's a concept here I'm not sure how to express in English: "Para el pensamiento liberal ... las limitaciones al ejercicio de determinados derechos no provienen del ser sino por el hacer..." This part about "el ser y el hacer" seems familiar, but I'm not sure how to get a good explanation of it in English. If you know what this is, and could give me a few terms to search for, or even just sum it up in 25-50 words, it would help me out. (Asking you for this in no way bends the rules of my project, in case you're concerned.) Thanks a lot!
